Montenegro offers favourable tax rates for property owners, including low transfer taxes and capital gains taxes. A comprehensive grasp of these rates is essential for investors seeking to optimise their returns.

 

 

Income Tax and Double Taxation Treaties

Individuals and companies alike in Montenegro typically pay between 9% to 15% in income tax, encompassing dividends and capital gains. Montenegro's Double Taxation Treaties delineate the distribution of taxes on cross-border income activities. Notably, Montenegro has such treaties with major EU governments like France, Germany, Italy, Ireland, and the Czech Republic, as well as with significant economies such as the UK, China, Russia, and Switzerland. However, there are currently no treaties in place with countries like Australia, Canada, India, Spain, and the US.

Annual Property taxes

Annual property taxes in Montenegro vary between 0.25% and 1%, with liability falling on the individual utilising the property, not necessarily the owner. These taxes are calculated based on the property's market value.

Title Transfer Tax

Effective from January 1st, 2024, buyers of real estate in Montenegro must pay a title transfer tax based on the property value:

  • 3% for property values up to 150k Euros

  • 5% for property values ranging from 150k to 500k Euros

  • 6% for property values exceeding 500k Euros

Additionally, a flat 3% transfer tax is levied on property buyers, with a 21% VAT added to the sale price if the building (e.g., house, hotel, factory) has not been previously sold. Montenegro's transfer tax is notably lower compared to other parts of Europe, such as Portugal (6.5%) and Spain (up to 10%), reducing the cost of selling real estate and enhancing market liquidity.

Important Montenegro Tax Incentives for Companies

A notable tax incentive for companies is the exemption from Corporate Income Tax (CIT) for newly established companies exclusively operating in the underdeveloped northern areas of Montenegro. This tax holiday lasts for the first eight years of operation and covers only the first €200,000 in company income taxes.
